ACCREDITATION AND LICENSING REGULATIONS
EMPLOYMENT SUPPORT (AZAV)
Cert-IT GmbH was already accredited by the Federal Employment Agency on June 6th, 2005 to allow educational institutions and measures. As part of the instrument reform, the authority for accreditation has been transferred from the Federal Employment Agency to the German Accreditation Body (DAkkS) since April 1st, 2012.

Since April 1st, 2012, the Accreditation and Licensing Ordinance for Employment Promotion (AZAV) has regulated - in conjunction with the law to improve integration opportunities in the labor market - the licensing of providers and measures. Since then, all institutions that carry out employment promotion measures have required approval, regardless of whether they want to participate in tenders or offer vouchers.

So-called expert bodies, such as Cert-IT GmbH, are responsible for approval. Cert-IT is one of the first professional bodies of this kind, which since 2005 has had the goal of providing quality and transparency at educational institutions for the benefit of job seekers, companies and the public sector.
FAQ AZAV Trägerzulassung
If you carry out employment promotion measures, you need approval according to the AZAV. A distinction is made between the following technical areas of application for the implementation of:

FB1: Measures for activation and professional integration
FB2: Exclusively success-related paid job placement
FB3: Career choice and vocational training measures
FB4: Vocational training measures
FB5: transfer payments
FB6: Measures for the participation of disabled people in working life

The specific measure only has to be approved if it can be used with an education voucher or an activation and placement voucher (AVGS).

The approval of measures according to AZAV is required for:

Measures of further vocational training according to the fourth section, SGB III, § 81 (education voucher)
With the law to improve the chances of integration in the labor market, the AZAV regulates the approval of institutions and measures of employment promotion.
The aim of the legislature is to increase the quality of labor market services, to improve the efficiency of the labor market policy support system and to create transparency and comparability among labor market service providers.

AZAV carrier approval
​
According to the AZAV, certain requirements are placed on applicants who need carrier approval from a competent body.
The regulations for the approval of providers and measures must be observed, insofar as these are contained in SGB III and in the AZAV. In addition, the competent bodies must observe the recommendations of the advisory board and the implementation instructions of the Federal Employment Agency when making their admission decision.

The applicant for carrier approval must demonstrate the following requirements:
​
that it has the required performance and reliability
that it is able to support the professional integration of participants into the labor market
that the management, teachers and specialists have sufficient training and professional experience
that his contractual agreements with the participants correspond to the requirements of the AZAV
that a quality assurance system is in place.

AZAV approval for measures
If you have an AZAV approval, you can carry out work promotion measures.
Approval by a competent body is required for the following measures:

Measures for activation and professional integration according to § 45 paragraph 1 sentence 1, no. 1-5, SGB III
Measures of further vocational training according to the fourth section, SGB III, § 81 (education voucher)

You have the option of obtaining both the carrier approval and the approval of your measures from Cert-IT.

Carrier approval expiration:
​
On the basis of our offer form, we will create an individual offer for you. As soon as we have received the signed offer, the approval process can begin.
​
We will put you in touch with an auditor that suits your company. The auditor will contact you and discuss the schedule. Appointments for the on-site audit can then also be blocked.
The application for carrier approval according to AZAV must be completed, signed and sent to Cert-IT in electronic form together with the required documents. The documents should be sent to us approx. 4-6 weeks before the planned audit date.
After our formal examination of the application, the auditor starts with the documentation check (1st stage audit) and creates a report on the auditability based on SGB III and the AZAV. You and the expert will receive the report.
If the 1st stage audit is positively completed, the auditor will arrange the on-site appointment (2nd stage audit) with you - if no appointment has been made yet - and the audit plan will be drawn up.
In the audit, the auditor checks the eligibility of your organization for approval on site
After the on-site audit has been completed, you will be informed in the final meeting whether corrective measures are still necessary or whether approval can be granted.
If the audit is positively completed, the auditor creates an audit report and at Cert-IT the certification committee finally decides on the issue of the certificate. If the decision is positive, the certificate will be created and sent to you together with the audit report.

Procedure for approval of measures
​
Before you want to allow a measure, your organization must be approved as a responsible body according to the AZAV.
Then you can apply for approval from a competent body for the following measures:

Measures of further vocational training according to the fourth section, SGB III, § 81 (education voucher)

In the first step, fill out the current version of the brief overview of measures and send it to Cert-IT as an Excel spreadsheet in electronic form.

We check the brief overview of measures and, if desired and possible, make the reference selection for several measures. We will inform you about this.
​
We request the application documents from you in a special folder structure.
​
Fill out the application for the approval of measures in the current version for the reference measures taken, sign it and send it together with the required documents to Cert-IT in electronic form.
Approximately 2-4 weeks should be scheduled for a regular review of measures. As soon as we have received the signed application for approval, the approval process can begin. After we have checked the application for completeness, we start with the review of measures. As part of the approval of measures, we check the existence of the requirements on a site-specific basis. We may commission one of our action reviewers to do this. The reviewer of the measures may contact you during the review.

After the test has been completed, you will be informed by e-mail if corrective measures (additional requests) are still necessary.
​
If the check of measures has been completed positively, the veto check is carried out and at Cert-IT the certification committee finally decides on the issue of the certificate. If the decision is positive, the certificate will be created and sent to you electronically.

Auf Grundlage unseres Angebotbogens erstellen wir Ihnen ein individuelles Angebot. Sobald uns das unterschriebene Angebot vorliegt, kann das Zulassungsverfahren beginnen.
Wir vermitteln Ihnen eine/n zum Unternehmen passenden Auditor/in. Der/Die Auditor/in kontaktiert Sie und bespricht den zeitlichen Ablauf. Termine für das Vor-Ort Audit können dann auch schon geblockt werden.
Der Antrag auf Trägerzulassung nach AZAV muss ausgefüllt, unterschrieben und gemeinsam mit den geforderten Unterlagen an die Cert-IT in elektronischer Form geschickt werden. Die Unterlagen sollten ca. 4-6 Wochen vor dem geplanten Audittermin an uns gesendet werden.
Nach unserer formalen Prüfung des Antrags, beginnt der Auditor mit der Dokumentationsprüfung (Audit 1. Stufe) und erstellt einen Bericht zur Auditierfähigkeit auf Grundlage des SGB III und der AZAV. Den Bericht bekommen Sie und die fachkundige Stelle.
Ist das Audit der 1. Stufe positiv abgeschlossen, vereinbart der Auditor mit Ihnen den Vor-Ort Termin (Audit 2. Stufe) – falls noch keine Terminvereinbarung getroffen wurde - und der Auditplan wird erstellt.
Im Audit prüft der Auditor die Zulassungsfähigkeit Ihrer Organisation vor Ort
Nach dem Abschluss des Vor-Ort Audits wird Ihnen im Abschlussgespräch mitgeteilt, ob noch Korrekturmaßnahmen notwendig sind oder ob die Zulassung ausgesprochen werden kann.
Ist das Audit positiv abgeschlossen, erstellt der Auditor einen Auditbericht und bei der Cert-IT wird im Zertifizierungsausschuss abschließend über die Zertifikatsausstellung beschieden. Bei einem positiven Bescheid wird das Zertifikat erstellt und an Sie gemeinsam mit dem Auditbericht verschickt.

There is a long-standing cooperation with the quality seal association for further education. A handout was developed for the educational institutions of the seal of quality association that would like AZAV approval, which gives an overview of where there are still AZAV requirements and how these can be integrated into your existing system.
We can also offer a parallel procedure with one auditor/assessor for both approvals, which reduces the audit effort in the facility.

Con!flex is the testing body for LQW and another cooperation partner. Numerous LQW-certified educational institutions have admitted themselves to us according to the AZAV because we have auditors with LQW expert qualifications and experience in our team. This means that a common language is spoken in the audit.
In addition, the Agency for Adult Education and Continuing Education, together with Cert-IT, created a recommendation and handout for educational institutions that have LQW testing and are seeking approval according to AZAV.
Another help is the self-report (www.qualitaets-portal.de/lqw-arbeitshilfe-qualitaetstools) in which the requirements according to AZAV have been integrated. This help prevents parallel structures from being set up and costs can be reduced by using synergy effects.

We also recognize the quality system for continuing education in Hesse, so that we can grant training providers who want AZAV approval a reduction in the audit effort.
FAQ Maßnahmenzulassung
Wenn Sie eine AZAV-Trägerzulassung haben, können Sie Maßnahmen der Arbeitsförderung durchführen.
Die konkrete Maßnahme muss nur zugelassen werden, wenn sie mit einem Bildungsgutschein oder einem Aktivierungs- und Vermittlungsgutschein (AVGS) in Anspruch genommen werden kann.
Für folgende Maßnahmen ist eine Zulassung durch eine fachkundige Stelle erforderlich:

Maßnahmen der beruflichen Weiterbildung nach dem vierten Abschnitt, SGB III, § 81 (Bildungsgutschein)
Die Anforderungen der Maßnahmenzulassung können Sie unserem Downloadbereich entnehmen. In den Antragsunterlagen werden Sie durch das Beantragungsverfahren geführt.
Im ersten Schritt füllen Sie die Maßnahmenkurzübersicht in der aktuellen Version aus und schicken diese an die Cert-IT als Excel-Tabelle in elektronischer Form.
Wir überprüfen die Maßnahmenkurzübersicht und treffen bei mehreren Maßnahmen, wenn gewünscht und möglich, die Referenzauswahl. Diese teilen wir Ihnen mit.
Die Antragsunterlagen fordern wir bei Ihnen in einer speziellen Ordnerstruktur an.
Den Antrag auf Maßnahmenzulassung füllen Sie in der aktuellen Version für die gezogenen Referenzmaßnahmen aus, unterschreiben ihn und schicken diesen gemeinsam mit den geforderten Unterlagen an die Cert-IT in elektronischer Form.
Für eine reguläre Maßnahmenprüfung sollten ca. 2-4 Wochen eingeplant werden. Sobald uns der unterschriebene Antrag auf Maßnahmenzulassung vorliegt, kann das Zulassungsverfahren beginnen. Nach unserer Überprüfung des Antrags auf Vollständigkeit, beginnen wir mit der Maßnahmenprüfung.
Im Rahmen der Maßnahmenzulassung prüfen wir das Vorliegen der Anforderungen ortsbezogen. Wir beauftragen dafür ggf. einen unserer Maßnahmenprüfer. Der Maßnahmenprüfer kontaktiert Sie ggf. während der Prüfung.
Nach dem Abschluss der Prüfung wird Ihnen per E-Mail mitgeteilt, wenn noch Korrekturmaßnahmen (Nachforderungen) notwendig sind.
Ist die Maßnahmenprüfung positiv abgeschlossen, erfolgt die Vetoprüfung und bei der Cert-IT wird im Zertifizierungsausschuss abschließend über die Zertifikatsausstellung beschieden. Bei einem positiven Bescheid wird das Zertifikat erstellt und an Sie elektronisch verschickt.

Der Bundesdurchschnittskostensatz (BDKS) gibt die Stundensätze an, die von der Bundesagentur für Arbeit für Teilnehmer pro Unterrichtseinheit in einer Maßnahme maximal gezahlt werden. Diesen finden Sie weiter unten auf dieser Seite im Bereich Downloads AZAV.
Der BDKS für Aktivierungsmaßnahmen richtet sich nach dem jeweiligen Ziel der Maßnahme.
Um den richtigen BDKS für FbW-Maßnahmen zu finden, braucht man eine entsprechende Systematikposition, welche die Berufe einordnet.
Für die Ermittlung der Systematikpostiton benötigt man die Klassifizierung der Berufe (KldB). Diese können sie mit Hilfe des Tätigkeitsschlüssels der Bundesagentur für Arbeit ermitteln oder über die KldB 2010 in der überarbeiteten Fassung von 2020.
Generell sollten die Maßnahmen nach dem Prinzip der Wirtschaftlichkeit und Sparsamkeit kalkuliert sein.
Dennoch ist es möglich den BDKS zu überschreiten. Die Überschreitung braucht allerdings immer eine Begründung für die Notwendigkeit dieser, da der BDKS in der Regel alle benötigten Kostenpunkte inkludiert. Kostenüberschreitungen von bis zu 25% werden von der FKS selbst entschieden.
Alle Überschreitung über diese 25% müssen in einem gesonderten Verfahren über das OS Halle laufen und dort geprüft werden. Dieser Schritt verlängert zum einen das Zulassungsverfahren und sorgt für zusätzliche Kosten.
Sobald eine Maßnahme abgelaufen ist, muss diese neu beantragt werden. Eine reine Verlängerung des ausgelaufenen Zertifikats ist nicht möglich.

Die Cert-IT kooperiert im Rahmen der Zulassung nach AZAV mit Güte- und Qualitätsgemeinschaften, die ihren Fokus im Wesentlichen auf Weiterbildung legen und einen durch und durch pädagogischen Ansatz verfolgen.

Bildungsorganisationen, die diese Qualitätssysteme verwenden, haben es deutlich einfacher, wenn sie eine Zulassung nach AZAV durch uns anstreben.

Mit der Anerkennung der Qualitätssysteme durch die Cert-IT müssen für die Zulassung nach AZAV keine Parallelstrukturen aufgebaut werden und der Auditaufwand vor Ort lässt sich reduzieren. Unsere Auditoren/innen sind zum großen Teil auch als Gutachter für diese Qualitätssysteme zugelassen und sprechen damit im Audit eine gemeinsame Sprache.

Es besteht eine langjährige Kooperation mit dem Gütesiegelverbund Weiterbildung. Für die Bildungseinrichtungen des Gütesiegelverbundes, die eine AZAV-Zulassung wünschen, wurde eine Handreichung entwickelt, die eine Übersicht gibt, an welcher Stelle es noch AZAV-Anforderungen gibt und wie diese in ihr bestehendes System integriert werden können.
Zudem können wir ein parallel laufendes Verfahren mit einem Auditor / Gutachter für beide Zulassungen anbieten, wodurch sich der Auditaufwand in der Einrichtung reduzieren lässt.

Con!flex ist die Testierungsstelle für LQW und ein weiterer Kooperationspartner. Zahlreiche LQW-testierte Bildungseinrichtungen haben sich bei uns nach der AZAV zugelassen, weil wir Auditoren/innen mit LQW-Gutachterqualifizierung und –erfahrung in unserem Team haben. Damit wird im Audit eine gemeinsame Sprache gesprochen.
Zudem wurde für Bildungseinrichtungen, die über eine LQW Testierung verfügen und die Zulassung nach AZAV anstreben, von der Agentur für Erwachsenen- und Weiterbildung gemeinsam mit der Cert-IT eine Vorgehensempfehlung und Handreichung erstellt.
Eine weitere Hilfe ist der Selbstreport ( www.qualitaets-portal.de/lqw-arbeitshilfen-qualitaetswerkzeuge) in den die Anforderungen nach AZAV integriert worden. Mit diesen Hilfen wird vermieden, dass Parallelstrukturen aufgebaut werden und durch die Nutzung von Synergieeffekten können Kosten reduziert werden.
