§ 1 Scope and provider

§ 2 Registration request

(1) The descriptions and information about our events on our website are used to submit a registration request on your part. You can register for events by e-mail, fax, post or online using the registration form on our website.

(2) When registering via our online registration form, you submit a binding registration request for the event you have selected and listed in the registration form by clicking on the [Book now] button.

​

(3) If you register by e-mail, fax or post, you submit a binding registration request for the event you have selected by sending the e-mail, fax or letter by post.

§ 3 Processing of the registration request and conclusion of contract

​

(1) We reserve the right to allow the applicant to participate in individual cases. There is no general right to participate.

​

(2) Since the number of participants for the events is limited for didactic and spatial reasons, the registrations will be considered in the order in which they are received. If the event is already fully booked, the person registering will receive a corresponding notification.

​

(3) To accept your registration request, you will receive a registration confirmation by e-mail, which also contains all information about the respective event and, if applicable, the invoice. With this confirmation of registration by Cert-IT, the registration becomes binding. The confirmation of receipt of your registration request is sent by automated e-mail or screen display immediately after sending the registration request and does not yet represent acceptance of the contract.

§ 4 Right of Withdrawal

When ordering services, consumers (§ 13 BGB) have the following right of withdrawal.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day the contract was concluded.

In order to exercise your right of withdrawal, you must inform us (Cert-IT GmbH, Am Bonner Bogen 6, 53227 Bonn, phone +49 228 6882280, fax +49 228 +49 228 688228-29, email: info@Cert-IT.com ) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

If you have requested that the provision of the services should begin during the cancellation period, you must pay us a reasonable amount, which corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract services compared to the total scope of services provided for in the contract.

§ 5 Fees and Payment

(1) The prices stated at the time of registration in our valid program of events apply. The prices stated on the event offer pages include the statutory sales tax to be charged by us and all other price components.

 

(2) The event and exam fees are per participant and include taking the exam and receiving the exam result by email. All other costs - for example for accommodation and travel to and from the event - are borne by you.

 

(3) You can choose to pay by credit card or invoice. When paying by credit card, your account will be debited with the confirmation of the registration. Invoices are to be paid within 14 days of receipt without deduction.

 

(4) Additional costs for foreign transfers must be borne in full by the customer.

 

§ 6 Representation, rebooking or cancellation by the participant

(1) You can cancel or rebook your registration before the start of the event under the following conditions or name a representative as a substitute participant. You must declare the cancellation, rebooking or appointment of a representative in text form by e-mail, fax or post. The time of receipt of the notification by Cert-IT is decisive for the time of your cancellation, rebooking or representation declaration.

You can nominate a substitute participant up to 72 hours before the start of the event, provided that he/she meets the requirements for the respective registration. In this case, however, we reserve the right to allow participation in individual cases. A separate and binding registration of the substitute participant in accordance with these General Terms and Conditions is required for a valid registration. After payment of the event fee by the substitute participant, your registration will be canceled and any fees already paid will be refunded, if applicable.

Up to 3 days before the booked event date, you can rebook your registration once free of charge for another equivalent event. Your rebooking declaration must contain the exact details of which event you want to rebook. Rebooking declarations that we receive less than 3 days before the originally booked event date will be treated as a cancellation.

You can cancel your registration. The following fees apply:

  • If you cancel more than 3 days before the start of the event, no fees will be charged.

  • If you cancel less than 3 days before the start of the event, 50% of the event fees are due.

  • In the case of later cancellations or non-participation, the full fee according to the invoice is due.

 

§ 7 Cancellations by Cert-IT

(1) Cert-IT reserves the right to cancel events if the minimum number of participants is not reached or for other important reasons for which Cert-IT is not responsible.

 

(2) If the minimum number of participants is not reached, this only applies up to 7 days before the start of the event.

 

(3) Only in the event of sudden, unforeseen events (e.g. if the speaker or the examiner falls ill or in the event of force majeure) can the cancellation be made at short notice.

 

(4) In these cases, Cert-IT will immediately try to find an alternative date.

 

(5) Event fees already paid will be reimbursed by Cert-IT in these cases. Further liability and damage claims, in particular the reimbursement of costs due to loss of work, travel or hotel costs, etc. do not exist, unless these are based on intentional or grossly negligent behavior on the part of Cert-IT, our legal representatives or employees or other vicarious agents.

 

§ 8 Liability, Damages

A. Liability towards entrepreneurs:

 

(1) The liability of Cert-IT for damages, for whatever legal reason, in particular due to impossibility, delay, defective performance, breach of contract, breach of obligations during contract negotiations and tortious acts, insofar as fault is involved, is in accordance with this § 8 A restricted.

 

(2) Cert-IT is not liable in the case of simple negligence on the part of its organs, legal representatives, employees or other vicarious agents, unless there is a breach of essential contractual obligations. An obligation is essential to the contract, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which you, as a test participant, can regularly rely.

 

(3) Insofar as Cert-IT is basically liable for damages in accordance with § 8 (2), this liability is limited to damages that we foreseen as a possible consequence of a breach of contract when the contract was concluded or that we should have foreseen if we had applied due diligence. In addition, indirect damage and consequential damage can only be compensated if such damage is typically to be expected.

 

(4) No liability is assumed for objects brought into the event room by the participant during an examination.

 

(5) The above exclusions and limitations of liability apply to the same extent in favor of our organs, legal representatives, employees and other vicarious agents.

 

(6) The limitations of this § 8 do not apply to our liability due to intentional conduct, due to injury to life, limb or health or under the Product Liability Act or due to a guarantee assumed by us.

 

B. Liability towards consumers:

 

(1) We have unlimited liability

- in the event of intent or gross negligence,

- for injury to life, limb or health,

- according to the provisions of the Product Liability Act and

- within the scope of a guarantee assumed by us.

 

(2) Furthermore, we are liable for the violation of essential contractual obligations. In the event of a slightly negligent breach of a material contractual obligation, we shall only be liable for the foreseeable damage that is typical for the type of transaction in question, unless the claims for damages result from injury to life, limb or health. An obligation is essential to the contract, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which you, as a test participant, can regularly rely.

 

(3) There are no further liability claims against us, regardless of the legal nature of the claims you have made against us. In particular, no liability is assumed for objects brought into the event room by the participant during an examination. Our liability according to paragraph B. 1 above remains unaffected by this.

 

(4) The above limitation of liability also applies to the personal liability of employees, representatives and organs of Cert-IT.

Cert-IT reserves all copyrights, including those of reprinting and duplication or making documents or examination questions or parts thereof publicly accessible. Documents or examination questions or excerpts thereof may under no circumstances be reproduced, duplicated, distributed, published or made publicly accessible in any form without written permission.

 

§ 10 Data carriers brought along, damage to our hardware and furnishings

 

(1) Data carriers brought by participants may not be imported onto Cert-IT's computers, or only with the express permission of Cert-IT. The event participant is liable for any resulting damage.

 

(2) In the event of damage to hardware and the equipment of Cert-IT, the customer is liable according to the statutory regulations.

 

§ 11 Choice of Law and Place of Jurisdiction

A. Applicable law and place of jurisdiction for commercial and public customers

 

(1) Contracts including these General Terms and Conditions are subject to the law of the Federal Republic of Germany.

 

(2) Place of jurisdiction for domestic customers: If the customer is a merchant and the disputed contractual relationship is attributable to the operation of his trade, Cert-IT can sue this customer in Bonn or at another competent court; the same applies to a legal entity under public law and special funds under public law. Cert-IT itself can only be sued by these customers in Bonn.

 

(3) Place of jurisdiction for foreign customers: The agreement on the place of jurisdiction under paragraph (2) also applies to customers who carry out a comparable commercial activity abroad, as well as to foreign institutions that are comparable to domestic legal entities under public law or a domestic special fund under public law are.

 

B. The following applies to all other customers, especially consumers:

(1) Choice of law: Contracts including these General Terms and Conditions are subject to the law of the Federal Republic of Germany. In the case of agreements for a purpose that cannot be attributed to either the commercial or the self-employed professional activity of the beneficiary (consumer), this choice of law only applies insofar as the protection granted by mandatory provisions of the state in which the consumer has his habitual residence is withdrawn.

 

(2) Place of jurisdiction: Both we and the customer can bring an action before any court having jurisdiction based on statutory provisions.

Section 12 Online Dispute Resolution

Online dispute resolution in accordance with Art. 14 Para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/ . Consumers have the opportunity to use this platform to settle their disputes. However, we are not obliged and not willing to participate in an out-of-court arbitration procedure.
